Cornice Files Countersuit Against Seagate
Cornice Inc. has announced that it has filed counterclaims against Seagate Technology in response to a patent infringement complaint filed by Seagate in June 2004.
Cornice Inc. has announced that it has filed counterclaims against Seagate Technology in the United States District Court for the District of Delaware in response to a patent infringement complaint filed by Seagate in June 2004.
In its counterclaims, Cornice seeks a ruling from the Delaware District Court that Seagate’s patents are invalid, unenforceable, and not infringed by Cornice’s products. Furthermore, Cornice alleges that Seagate’s lawsuit is objectively baseless in that no reasonable litigant would have brought such a suit, and that Seagate’s actions constitute unfair competition and tortious interference under Colorado law, entitling Cornice to damages from Seagate.
Both Seagate and Western Digital had pursued legal action against Cornice, on the grounds of copyright infringement in recent months.
