Lawyer Blasts Apple’s ThinkSecret Suit
Terry Gross, the attorney representing ThinkSecret owner Nick Ciarelli goes on the offensive asking the case to be thrown out.
“The lawsuit against Ciarelli, Gross said, wasn’t filed by Apple to find out the sources of the leak — they could have just subpoenaed the information. Rather, it was intended to intimidate bloggers, or “citizen journalists” as they sometimes call themselves, from publishing confidential information. “
Terry Gross plans to file a motion in February to dismiss the case with the court on the grounds of First Amendment rights.
Apple has gone after several Apple fan sites claiming the publications leaked secrets and information crucial to the company’s success.
Gross makes a good arguement that the suit never would have been filed if the information came from a source like the Wall Street Journal or Washington Post. Thinksecret was viewed as an easy target he says.
We have a seperate view of the whole incident: If the information seems shady – don’t post it. But then again, we don’t have the word “secret” in our name. Hopefully ThinkSecret wins this quickly and can put it behind them. We wish the website the best of luck.
