iPhone vs Galaxy S lawsuit doctored picture

First we saw a modified picture of a Galaxy Tab next to an iPad, and now reports of a modified picture of a Galaxy S phone next to an iPhone.

Apple’s case against Samsung has so much drama it is starting to sound like a bad soup opera. A Dutch publication (translated) is reporting that Samsung’s lawyers are accusing Apple of doctoring pictures of the Samsung Galaxy S phone. This time the case in question is based in the Netherlands, and not Germany. Apple’s suit against Samsung is based on the fact that the devices look so similar that a consumer might get them mixed up. In the picture supplied by Apple the two devices look extremely similar, but when compared to a normal sized Galaxy S the difference is clear.

Earlier this week there was a similar story posted based around the Galaxy Tab 10.1, but there seems to be a key difference between that story and this one. There was no real implied guilt in the tablet picture, mostly just pointing out that the picture provided looked modified. The ban against Samsung has been lifted, but for reasons other than the doctored picture.  In today’s story Samsung’s lawyers are actually accusing Apple of changing the picture.

It is pretty shocking if the accusations are true, and Apple purposely did change the pictures in question. The iPhone 3G and 3GS are 115.5mm tall, while the Samsung Galaxy S phone is 122.4mm. In the picture supplied by Apple they are the exact same height, which is one of the reasons they look so similar. Seeing as the iPhone has a 3.5inch display and the Galaxy S has a 4inch display they clearly aren’t going to be the same size. So the question is does the 6.9 mm change to the picture really change the look of the phones side by side?

  1. axisofweevil at 6:22am 21st August 2011 Apple is so full of it it's not even funny anymore. I'm no fan of Samsung but their Galaxy is SO much better spec-wise than iPhone it's not even a fair fight. Apple has a better ecosystem but they couldn't be satisfied with that...

Sandie Parrish at 2:13am 20th August 2011 This is crazy, I know almost everyone knows what an IPhone looks like however not everyone knows what the Samsung Galaxy S looks like other than the big spider picture on the phone getting stomped at the restaurant. I love my Galaxy S it is much taller than the IPhone works so much better, videos, pictures, apps oh and it works great as a phone too! I would never trade it for an apple product unless they really start making some better products. They made the cutting edge for years, now it seems to be just cosmetic upgrades!

    1. Mike Dunn at 12:35pm 20th August 2011 I think there are only so many ways that touch screen phones and tablets can look. With ice cream sandwich coming out soon which won't need physical buttons it's going to be even harder to make them look different.
  4. James Phillips at 1:02am 20th August 2011 Apple isn't doing its image any favors with this nonsense. The whole "consumer might me confused" angle might hold water in the case of trademark infringement when one company uses a phrase that sounds very like another's trademark, but really, this kind of law rests on what a "reasonable" consumer might think. And NOBODY is going to leave the store with a Samsung Galaxy having been duped into thinking it was an iPhone. You don't just pick phones off the shelf and put them into a shopping basket. You have to ask for them by name, or choose them online by name. So what's Apple's point here? Form factors are so narrowly defined that it's almost impossible to avoid one phone looking like another. Just concentrate on making a better phone than Samsung, Apple, instead of making yourselves look like dicks with these frivolous lawsuits.
