Apple argued yesterday that Samsung’s Galaxy Note 10.1 tablet and the Android 4.1 Jelly Bean operating system infringe on its patents and should be added to an existing California lawsuit against Samsung.
Appearing in a federal court in San Jose, before U.S. Magistrate Judge Paul S. Grewal, Apple’s lawyers sought to expand the lawsuit against Samsung with additional patent infringement claims. This follows Samsung’s attempt to add patent infringement claims against the new iPhone 5 back on October 1.
The judge has not issued a ruling yet.
Most notable among Apple’s claims is the inclusion of Google’s Android 4.1 operating system, also known as Jelly Bean. Apple insisted that the Galaxy Nexus is the only phone with Jelly Bean that it is seeking to add to the patent complaint, for now. The implications of this are serious for Google and it’s the first time that Apple has included the Android platform specifically in its cases against Samsung.
It seems the Cupertino-based company is also now looking to add devices with a stylus, such as the Galaxy Note 10.1, and Apple’s attorney mentioned adding a further 17 devices that could use a stylus, but don’t ship with one.
This case is not scheduled for trial until 2014.
We will find a resolution to the highest profile case so far sooner than that. The jury verdict saw Apple awarded $1.05 billion in damages. As we reported before, Apple is seeking more money while Samsung is claiming juror misconduct. Those arguments will be heard in December and there will also be a decision on Apple’s attempt to get eight Samsung smartphones banned from sale in the U.S.

LOL – Apple just mad at the iPhone bashing commercials? Or the fact that Samsung actually has a better product than theirs? All I know is this is getting ridiculous and makes me not even remotely consider buying any i device EVER! Of course it does help that Android RULES!!
I am a big Apple fan, but all of these lawsuits are making me embarrassed/ashamed of the company. They need to give it up already. They are starting to get a bad guy image fast (and arguably more than they already had).
Hello Ian, I am a big fan of Apple too. Google is trying to overtake the iPhone and Apple is trying to stop it by trying to eliminate Samsung at first. Android is indeed a stolen product (it’s no coincidence that Android was released a year after Steve Jobs unveiled iOS in 2007) and if companies such as Samsung stop feeling threatened by Apple, they won’t hesitate to steal and copy even more of Apple’s magic every year.
Android is here to stay. Time for Apple to get over being jealous of a competing product. The two are NOT the same. Remember when Apple whined about MS being a bully with competing software products. Now Apple is the bully in a market where it needs competition to stay relevant and fresh. Otherwise Apple wouldn’t be bringing out new updates every six months.
Microsoft’s Live Tiles are one of the points it keeps bringing up about how Windows Phone 8 differs from iOS, which has static icons on its screen. I call this innovation as long as their OS is completely Apple-free. Why didn’t Google (Android) came up with something new instead of copying Apple’s interface?

Seriously… Apple needs to stop. They are trying to bully the competition out of the picture. They can’t stand that there is another company that has a better product then them, and they will cry all the way to the courts. They really look like bad sports with all of these lawsuits.
We can’t they just act respectable and fight it out in the marketplace to let the consumer dictate the better product instead of attempting to annihilate the competition in the court.
If Android did get an injunction or even worse, forbidden to sell their product, wouldn’t that get the government to step in concerning Apple’s new monopoly on the smartphone/tablet industry?
Soon Apple will try to add any device that uses a battery … then any device that uses a rechargeable battery … then any device that uses a charger … then any device that has internal memory.

I don’t understand why Apple would sue Samsung for Jelly Bean when it’s an Android/Google thing NOT Samsung. Why? Maybe they are too pussy to go after Google? I wish Google would (somehow) disable Google search from ALL Apple products or play hardball like they did with Google Maps. Yeah, have fun using Bing or Yahoo Search Bitch.
If one goes back in time, the first mobile device I had that looked ALOT like iOS was a pocket PC by microsoft running Windows CE. The size was nearly identical. it had about 5 rows of icons about the same size. I could do email, take (crappy) photos, had a GPS, play music. This predates the iPhone by about … 8 years or so. It also had a stylus. So I could easily, easily argue that Apple stole their look and feel completely from this Microsoft thing. I remember vividly when I got the first iphone in 2007, I was like.. “wow… looks almost identical, except in black, to my old Windows thing.”.
So who stole what?
Apple has shifted its innovation mantra away from products to nasty lawsuits. Examples: Apple failed to anticipate Foxconn’s limits to producing the new iPhone. Sloppy planning. Apple whines about Motorola’s high patent licensing fees, while suing everyone else over apparent infringement. What goes around, comes around. I predict all this will backfire on Apple in several big ways: some patent holders will withhold granting licenses to Apple in favor of Android, and consumers won’t benefit from any of the squabbles because prices will go up when Apple is forced to pay higher licensing fees. And Apple will have to make all of its components because other manufacturers like Samsung won’t sell anymore to Apple. Watch for more of it. It’s already started.
I do wonder if suing has hurt Apple’s reputation or is doing real damage to it. It’s a difficult thing to gauge.
On Apple’s best day their piece of garbage OS Ios6 doesn’t even come close to any Android operating system. Apple’s Iphone is so inferior to any Android device it is not even funny. Keep hitting the snooze on your 15 minutes Apple you hack of a company. Nice try. I would wipe my ass with an iphone and that’s about it. The phone is crap and barely works.
