Not that stupid, really. If the name hadn’t been a registered trademark for ten years, I’d say it’s stupid. But you can’t even use the name Twitter or MySpace on anything because both are registered trademarks and can’t be used in any way shape or form. That’s what trademark registration was put in place for.

Also, to those who don’t know much about the law, a registered trademark is property of the company. And when any other company tries to use it, that is wrongful use of a registered trademark. And the original company suing over it, doesn’t sue to “gain” anything, but to protect the assets of the company.

yeh, but no one’s heard of the financial company and everyone’s heard of Motorola. they’re just looking for a fast settlement. but they know, and the judge will point out, that the financial services company only stands to gain, not lose, because of Motorola’s use of the word.
