Trademark Infringement? There’s An App for That!

Trademark Infringement? There

Despite its considerable success—and a host of imitators—Apple’s iTunes App Store has had its share of black eyes, ranging from vague approval requirements that have the company refusing to distribute developers’ wares to blocking applications because they can access content Apple deems objectionable. (The latest example of the latter: Eucalyptus, an e-book reader Apple initially rejected because it could access the Kama Sutra via Project Gutenberg. Apple has since reversed its stance and the Eucalyptus is now available.) But last week the App Store briefly got into a new fracas: luxury goods maker Cartier filed suit against Apple for offering two applications the company claimed infringed on its Tank watch trademark.

Thailand Tries To Close 400 Sites

The Information and Communication Technology Ministry (ICT) in Thailand is taking drastic action against a large number of web sites that it claims "disturbed the peaceful social order and morality of the people, and/or which were considered detrimental to national security" and contravened the Computer Crime Act, according to the Bangkok Post.

It’s seeking court orders to close 400 sites and advising ISPs to block 1200 others, and has asked the police to help “bring all the violators to trial.”

Among them are sites deemed to carry obscene content and over 300 the ICT claims are contemptuous of the Thai Royal family.

Alleged software pirate arrested

Maksym Kovalchuk, 25, of Ternopil, Ukraine, was nabbed Tuesday at an ice cream parlor. He was taken into custody with the aid of Royal Thai Police on a criminal complaint filed in San Jose, Calif., in 2000. Thai authorities identified Kovalchuk as Maksym Vysochanskyy.

In the complaint, Kovalchuk is charged with trafficking in counterfeit goods, copyright infringement, money laundering and possession of unauthorized credit card information.

The U.S. attorney’s office alleges Kovalchuk sold counterfeit copies of software titles from companies such as Microsoft Corp., Autodesk, Adobe and Macromedia online. The retail value of the products pirated and sold, had they been authentic, would have been $3 million, authorities said.
