Ebay Beats L’Oreal in UK Counterfeit Goods Case

Online auction giant eBay has won a trademark infringement case brought against it by luxury goods maker L’Oreal (which also owns Yves Saint Laurent and Lancome), in which L’Oreal had tried to argue that eBay was liable for trademark infringements from users selling counterfeit goods on the service. While the court essentially agreed eBay could be going more to prevent trademark infringement, it ruled the auction giant doesn’t have any liability for trademark infringements committed by its users.

The decision follows similar judgments in Belgium and (just last week) in France, although L’Oreal won two cases in Germany that involved counterfeit perfumes and products sold without packaging.

After losing a pair of high profile counterfeit cases and being stung with millions in fines, the tide appears to have turned for eBay in court. Yesterday it won a famous victory in France, where it had been sued by cosmetics maker L’Oreal over fake perfumes sold on the auction site.

A Paris court judged eBay not responsible for counterfeits sold by users, even though L’Oreal said it believed up to 60% of perfumes sold as luxury brands on eBay were fakes. The court decided eBay had lived up to its obligations, and urged the two sides to use mediation to resolve the issue.

Internet search giant Google has released its 2008 End-of-Year Zeitgeist, noting what was hot worldwide in Internet searches for the year. Unlike search engines like AOL and Yahoo who base their end-of-year summaries mostly on the frequency of terms—hence allowing Britney Spears to rule the search engine listings for years on end—Google bases its Zeitgeist both on frequency and on the novelty of terms. In other words, 2008’s zeitgeist is more about what users searched for in 2008 that they were not searching for in 2007. Google claims their method is more indicative of the “spirit of the times”…and it definitely produces some different results.

Akamai: China and U.S. Lead in Net Attacks

Internet distribution company Akamai has issued the first of what it claims will be an ongoing series of State of the Internet reports. (Registration required to view the full text.) In the report, the company finds that during the first quarter of 2008, China and the United States accounted for about 30 percent of all “attack traffic” on the Internet—but, surprisingly, a lot of that traffic was directed at network ports and services that haven’t had major vulnerabilities for several years, suggesting the number of unpatched, still-vulnerable Windows systems connected to the Internet worldwide is still significant.

Orange Lands Multi-Country iPhone Deal

Apple continues to sign agreements with international mobile operators to bring the company’s iPhone to a larger market, just as the company is reportedly prepping to launch a new 3G-enabled version of the device, along with version 2.0 iPhone software. Today’s announcement come’s from France’s Orange, which issued a one-sentence statement saying it has reached an agreement with Apple to distribute the iPhone in Austria, Belgium, the Dominican Republic, Egypt, Jordan, Poland, Portugal, Romania, Slovakia, and Switzerland later in 2008, as well as Orange’s African markets.

Zattoo Streams European TV

Zattoo has launched a service in several European countries that allows users to stream terrestrial TV channels from their own countries (plus a few others fromabroad) to the computers.   The legal service uses a proprietary player, which is available as a free download, and works on both PC and Mac. Currently available in Belgium, Denmark, France,Germany, Norway, Spain, Switzerland, and the UK, the company has big plans to expand not only the number of countries included, but also the number of continents.   It works as a peer-to-peernetwork, with the watched program flowing from one computer to another. In the UK, viewers can catch a total of 29 channels, including all five terrestrials, BBC3 and BBC 4, Al-Jazeera, ABC News Now, as well as news from France and Germany and, most importantly for some, the PokerChannel.   Alexandra Illes, manager for Zattoo in the UK, said:   “People often have to compromise their viewing choices with other household members, such as their flatmates orpartner,. Zattoo helps eliminate this as anyone with a computer and internet connection can watch TV via the internet. It’s just like owning another TV."

Luxembourg-based Gax Technologies will hold a real career fair in the virtual world on May 29, giving players a chance to meet with prospective employers without even leaving their computer chairs.

 Working Worlds is actually the second career fair Gax has organized through Second Life. The company held its first Career Fair for Luxembourg last year, which ended up drawing 2,000 visitors, netting 50 of them real jobs. Inspired by the success of the original, the company has expanded with Working Worlds to include employers from Belgium and the Netherlands as well.

Microsoft has announced an ambitious new program which aims to put professional-level software and Internet development tools in the hands of students—for free. Dubbed “DreamSpark,” the offering will make Microsoft development and design tools available for download to more than 35 million college students in the U.S, UK, Belgium, Switzerland, Spain, Sweden, Finland, France, Germany, and (tellingly) China, and Microsoft plans to expand the program to as many as a billion students by including high school students next year.
