Microsoft May Get a Class Action Lawsuit from Xbox Bans

xbox-360Gamers are really into tweaking their gear for fun and to achieve the best performance during gameplay. PC gamers overclock their hardware to get more performance for less money and console gamers have modded their Xbox 360 consoles for many reasons (some for innocent reasons, some for nefarious reasons).

Microsoft appears to feel that the only reason to mod an Xbox 360 is to allow the console to play pirated download software. A law firm based in Texas that specializes in IP has launched a new website to gather Xbox 360 users who have been banned for modding their consoles. The main goal of the firm is to find out whether there are enough console owners that were banned to start a class action suit against Microsoft.

Sony BMG Settles DRM Case with FTC

The debacle regarding copy-protection software tucked away on certain Sony BMG audio CDs has taken one more step into the history books. Sony BMG has agreed to a settlement with the FTC, and, in doing so, acknowledges that it violated federal law by not telling consumers its music CDs contained digital rights management software and tracked user listening to send them marketing messages.

The software also exposed consumers to security risks, as attackers became aware of how the copy protection technologies distributed by Sony operated and began crafting malware which could be cloaked by the Sony-installed software.

SEC investigates game industry

The Securities and Exchange Commission in the United States has begun a probe into a number of accounting practices in the games industry, with Acclaim, Activision and THQ all confirming that they are under scrutiny.

The three publishers were notified of the probe earlier this month, according to a Reuters report, and have been asked to supply the SEC with information relating to company accounts and accounting practices.

It’s not known which other publishers may have been asked for information, but the investigation is thought to be a wide-ranging one which encompasses the whole industry, rather than being focused on the three named publishers.
