Comcast Faces Net Neutrality Complaint

Legal scholars from Yale, Harvard, and Stanford along with public advocacy groups have filed a network neutrality complaint (PDF) with the Federal Communications Commission against U.S. cable provider Comcast, claiming the company is intentionally degrading network performance and discriminating against customers’ use of the network—specifically, blocking the use of peer-to-peer file sharing applications like BitTorrent and Gnutella. If the complaint moves forward, it could be the first major test of the FCC’s network neutrality principles.

Although these principles are not law, the FCC indicated a strong willingness to enforce them via its regulatory authority shuld it see evidence communications providers were violating them.

Dell Faces Investor Lawsuit Over Kickbacks

An investor lawsuit filed last week against computer maker Dell by the Lerach Coughlin law firm in Austin, Texas, alleges the company accepted and then tried to cover up up to $1 billion in “secret and likely illegal” payments from shipmaker Intel. According to the complaint (PDF), the “exception to corporate average pricing” (e-CAP) payments had a material impact on Dell’s reported profits to the tune of around $250 million per quarter; in exchange, Dell exclusively utilized Intel processors in its products.

Cingular/AT&T Tops Customer Complaints

“Complaint data obtained by Consumers Union, publisher of Consumer Reports and ConsumerReports.org, from the Federal Communications Commission show that Cingular and AT&T, which combined last year to form the nation’s largest wireless phone company, have the worst combined complaint record for 2004. AT&T alone has had the worst complaint record two years running.

If you’re considering a change of wireless carrier, you may want to look first to Verizon. It had the lowest number of complaints per customer among national carriers, and among all the carriers, relatively few complaints about service quality and billing. “

China Dismisses U.S. Chip Complaint

The potential complaint would be the latest in a string of pre-U.S. election skirmishes as congressional anger grows over low-cost China’s $125 billion surplus with the United States.

The United States could soon lodge a complaint to the WTO against China–breaking from a trend of resolving spats directly with Beijing–over tax breaks enjoyed by chip companies based on the mainland, U.S. officials say.
