Dell And HP Support Microsoft In Word Case

The injunction against Microsoft selling Word after October 10 is having some large ripples. It doesn’t affect just Microsoft, but also the computer makers who ship software with their machines, and two of them have weighed in on Microsoft’s side.

According to the Groklaw legal news site, both Dell and HP are asking for an extension before the injunction takes effect, and Dell has already filed a brief, asking for an extension of 120 days.

A lot of the computers sold by both companies arrive with Word – or at least Microsoft Office – pre-installed, and an injunction would mean big changes to their system. The extension would give time for the appeal, which has been fast-tracked, to be heard.

A federal judge has stayed a permanent injunction against Buffalo Technology, clearing the way for the company to sell 802.11a, g, and n products in the United States. The injunction goes all the way back to 2007, when the Australian science agency CSIRO sued Buffalo, alleging that the company’s products infringe on a patent covering aspects of Orthogonal Frequency Division Multiplexing, a method of dividing Wi-Fi channels into narrower subchannels to improve performance. A district court initially found that Buffalo infringed on aspects of the patents, and ordered Buffalo to stop selling infringing products in the United States. The result was that Buffalo was effectively locked out of the U.S. market during the initial boom of high-performance draft-N Wi-Fi gear sales, which undoubtedly hurt the company’s bottom line.

Court Bars Ex-IBMer from Position at Apple

Only days after Apple announced that ex-IBM veteran Mark Papermaster would be taking over as chief of its iPod division, a New York court has barred him from taking the position. IBM succeeded on Friday in winning a preliminary injunction to temporarily prevent Papermaster him from working with Apple, due to a contract he signed in 2006.

According to IBM, the non-compete contract Papermaster signed in 2006 prevents him from working for IBM competitors for one year – which Apple qualifies as in the server business. Since Papermaster only left IBM in October and was slated to begin work at Apple in November, IBM claims he has violated the contract. New York Federal District Judge Kenneth Karas granted the company’s injunction on Monday, preventing Papermaster from taking the position until further discussion.

Judge to Issue VoIP Injunction On Vonage

U.S. District Judge Claude Hilton said on Friday that he will issue an injunction barring Vonage from using VoIP technology patented by Verizon Communications. However, Judge Hilton said he would delay signing the order by two weeks in order to give Vonage an opportunity to convince him the injunction should be stayed while the company appeals its entire case.

The move comes after a federal jury found Vonage had infringed on three key Verizon patents and ordered the company to pay $58 million in damages plus a 5.5 percent royalty on future sales.

Injunction Issued Against DVD Copying Maker

Macrovision received the preliminary injunction in its patent-infringement lawsuit against 321 Studios, already forbidden by federal judges in recent months from selling its DVD-cloning software.

Less than two weeks ago, 321 founder Robert Moore told a congressional panel the court rulings have put his company “on the brink of annihilation.” He said 321 had expected to generate $100 million in sales.
