Justice Investigates Yahoo, Apple, And Google

Did they or didn’t they? That’s the question a Justice Department investigation will attempt to answer as it begins an investigation into the hiring practices of Google, Yahoo, and Apple.

At the heart of the matter is whether there was an agreement between the companies not to headhunt each other’s senior staff, which would stifle competition if any pact was formal. The Washington Post has been told by sources that the investigation could move to other tech companies, too.

Google and Apple are already under the FTC lens for sharing board members, according to Vnunet.

AMD Confirms Graphics Antitrust Probe Over

Chip maker AMD has confirmed that the U.S. Department of Justice has closed the antitrust investigation into ATI’s graphics business, and that no action will be taken against AMD or its ATI business unit. The Justice Department launched the investigation in late 2006, issuing subpoenas for both ATI and Nvidia in an investigation into antitrust violations in the graphics market.

No charges were levied against either Nvidia or ATI, but the investigation reportedly focused on charges of price-fixing, specifically that ATI and Nvidia colluded to artificially set the prices for graphics processors and technology. During the course of the investigation, industry reports also had the Department of Justice examining the marketing practices of both companies.

US Govt. Workers Fired For Online Porn

You’d think they’d know better. After all, they work for the Office of the Chief Technology Officer in Washington DC. But no, apparently not. Nine employees have been fired for using their work PCs to watch porn during working hours. And that’s not just casually. An five-week investigation determined that the nine visited an “egregious” number of porn sites during 2007, Vnunet reports (how many sites does it take to be egregious, anyway?).   The investigation involved a forensic examination of 10,000 city computers and followed a complaint by someone in the Office of Property Management about colleagues downloading pornographic images at work.   Although nine have gone, the investigation hasn’t yet concluded. If other offenders are found, they could face disciplinary action, raging from warning letters to firing, based on the number of times they visited porn sites from work.

ITC Investigating Hard Disk Makers

The United States International Trade Commission has announced that it has opened an investigation into five companies after allegations that hard disk drive products made by and used by the companies violate technology patents. The investigation will focus on hard drive technology from Western Digital, Seagate, and Toshiba, as well as computer makers Hewlett-Packard and Dell.

The ITC’s investigation responds to a complaint from Steven and Mary Reiber, of Lincoln, California, filed on September 10, 2007, alleging that certain hard disk drives (and the companies using those drives) infringe on patents covering “dissipative ceramic bonding tips.” The complaint seeks a ban on importation of products which violate the patent. The ITC announcement does not disclose the patents in question, but the U.S. Patent and Trademark Office shows several patents on file (including 6,935,548, 6,651,864 and 6,354,479 related to the technology.

Dell Audit Finds Evidence of Misconduct

Computer maker Dell has announced that the company’s internal audit committee has found evidence of a number of accounting errors as well as outright misconduct. The company also said evidence of “deficiencies in the financial control environment” will lead the company to delay it’s Form 10-K filing for its fiscal year ending in February as it determines whether the errors and deficiencies will impact prior financial statements. Financial statements issued for that fiscal years’ final three quarters have only been issued in preliminary form and have yet to be finalized.

DOJ Investigating Online Music Pricing

The U.S. Department of Justice says its Antitrust Division has launched an investigation of major music labels into possible anti-competitive practices in digital music pricing. Although few details have been released, the investigation would seem to follow in the steps of a similar probe being conducted by New York attorney general Eliot Spitzer. Although no details have been released and sources describe the investigation as been in “early stages,” the investigation appears to be focussed on whether the major music labels colluded to set wholesale price points for music downloads.

SEC investigates game industry

The Securities and Exchange Commission in the United States has begun a probe into a number of accounting practices in the games industry, with Acclaim, Activision and THQ all confirming that they are under scrutiny.

The three publishers were notified of the probe earlier this month, according to a Reuters report, and have been asked to supply the SEC with information relating to company accounts and accounting practices.

It’s not known which other publishers may have been asked for information, but the investigation is thought to be a wide-ranging one which encompasses the whole industry, rather than being focused on the three named publishers.
