EFF Sues to End U.S. Domestic Spying

The Electronic Frontier Foundation has filed suit against the National Security Agency—as well as President Bush, Vice President Cheney, former Attorney General Alberto Gonzales, Cheney’s chief of staff David Addington, and other individuals—on behalf of AT&T customers in an effort to end ongoing government monitoring of telephone records. The lawsuit is the EFF’s latest move against what it characterizes as “unconstitutional and illegal dragnet surveillance” of American citizens, and alleges that the monitoring violates the U.S. Constitution in addition to federal privacy laws.

NY Attorney General Sues Dell on Deception

New York State Attorney General Andrew Cuomo has announced that his office has filed a lawsuit against computer maker Dell and its affiliate company, Dell Financial Services LP, allegeding numerous deceptive “bait and switch” advertising and failing to live up to customer service promises.

“At Dell, customer service means no service at all,” said Cuomo in a statement. “Dell’s consumers were intentionally misled, and they had to pay for that privilege. I hope this lawsuit sends a message to companies large and small that delivering a product is simply not enough—the promises they make must be delivered as well.”

Apple Sued Over ‘Tiger’ Name

“Tiger Direct, which sells computers and related products on the Internet, said Apple’s Tiger OS threatens to dilute its trademarked name, according to Bloomberg, which has obtained a copy of the lawsuit.

The online retailer also accused Apple of deceptive and unfair trade practices in the lawsuit, filed today in federal court in Miami, Florida, Bloomberg said.

“Apple Computer has created and launched a nationwide media blitz led by Steven Jobs, overwhelming the computer world with a sea of Tiger references,” Tiger Direct’s attorneys wrote in the lawsuit.”

HP Sued For Misclassifying Employees

“The lawsuit, filed Monday in U.S. District Court in Boise, claims that the misclassification denied benefits such as health insurance, vacation and sick leave, and retirement plans to more than3,000 HP workers throughout the United States. The suit seeks more than $300 million in damages.

The 33 named plaintiffs, most from the company’s Boise plant, claim they qualify as employees instead of contractors under a questionnaire used to determine employee status by the Internal Revenue Service. “

Best Buy Faces Lawsuit Over Layoffs

“According to the lawsuit, 126 IT workers were terminated in June. Stephen Snyder, the Minneapolis-based lead attorney for the plaintiffs, said that 82 of those workers were at least 40 years old — the minimum age required to file an age-discrimination claim. Thirty-one of the plaintiffs were among the workers who were dismissed in June.

The 13 other plaintiffs lost their jobs when Best Buy laid off a total of 25 IT workers last year, according to the lawsuit. Twenty of them were at least 40 years old, Snyder said. The lawsuit noted that another worker turned 40 the day after he was laid off.”

Xbox Drive Errors Inspire Lawsuit

“Burke’s lawsuit, filed in Los Angeles Superior Court earlier this week alleges that the Xbox DVD drive has a propensity to fail “after unreasonably, unconscionably, unusually and unexpectedly short amounts of time.”

Unusually, Microsoft responded to the suit in a statement. “We’ve designed and manufactured the Xbox with the highest quality standards and our customer satisfaction is very high,” representatives said, according to reports from Reuters news service. “

Here is a thought: instead of paying your attorney, buy a new Xbox. This is looking like another “get-rich” scheme to pull some money out of the Redmond giant. Sony has had similar drive problems with early versions of their Playstation 2 console, but nothing spurred a lawsuit like this.

AOL Announces New Round Of Spam Lawsuits

AOL’s lawsuits are noteworthy and unique in nature. The first AOL lawsuit, filed against twenty “John Does”, is the Company’s very first lawsuit that expressly targets “SPIM” – unwanted communications to online consumers via instant messaging tools or chat rooms.

The other lawsuit is the very first AOL legal action to target a spammer peddling controlled substances, including Vicodin and other pharmaceuticals, which are legally available only with a physician’s prescription. This lawsuit, filed against ten “John Does”, is also noteworthy because it is the first time AOL is filing a spam lawsuit based on a large number of complaints specifically determined to be from AOL Europe and AOL Canada members.

Game Makers Add To 321 Studios Troubles

The federal lawsuit, filed in New York, says that Games X Copy software, marketed by 321 Studios of suburban St. Louis, violates copyright law by thwarting anti-piracy protections.

The lawsuit represents a new legal front against 321 Studios, already at odds with Hollywood over the company’s DVD-copying software. Federal judges in New York and California have barred 321 from marketing the movie-copying software.

Tuesday’s lawsuit was filed by Atari, Electronic Arts, and Vivendi Universal Games. The lawsuit asks for a court order blocking the sale of Games X Copy and seeks unspecified damages.

31 Companies Sued Over JPEG Patent

In use since the mid-1980s, the JPEG, or Joint Photographic Experts Group, format has become the de facto standard for sharing photo-quality images electronically. Although the most widely used version of the format is in the public domain, Forgent said it believes that a 17-year-old patent it acquired through the purchase of Compression Labs in 1997 can be applied to a specific algorithm in the format.

Defendants in the lawsuit include some of the biggest names in the computing industry, from Apple and IBM to Kodak and Xerox — all of which use JPEG in their products. Forgent contacted each of the companies over the past year and offered them the chance to license the technology, said Forgent spokesman Michael Noonan. But none accepted, he said.

AT&T, Microsoft Settle Patent Lawsuit

Microsoft, based in Redmond, Washington, settled most of the claims AT&T lodged in a lawsuit against the world’s largest software maker “by making a payment,” the companies said in a statement.

Both parties also “agreed to appeal a single issue (in the lawsuit) to the Federal Circuit, with another payment contingent on the outcome of the appeal.”
