Microsoft is getting ready to launch its new Zune HD portable media player on September 15, but the company has opened pre-orders for the device, letting Zune fans plunk down some dollars for the privilege of being one of the first people to have a Zune HD when they’re available. Customers can pre-order the devices in 16 and 32 GB capacities through Microsoft itself, as well as through retailers like Wal-mart, Best Buy, and Amazon.com. The 16 GB black version is priced at $219.99, while the Platinum 32 GB edition is priced at $289.99.

Are Apple and Google Flaming Out?
Over the last two weeks, the discussions surrounding Apple and Google have me wondering whether both companies have completely lost their collective minds. The US government now has a series of investigations surrounding both firms, ranging from collusion between them, to Apple pulling Google Voice off the iPhone. To be clear, this is like trying to find out if the companies were working together closely as criminals, or whether Google is Apple’s kick toy.
At Black Hat, one of the large security conferences where Microsoft is typically the whipping boy, Apple was front and center, with stories of potentially catastrophic problems on every product but the low-end iPods. Apple’s response to these, apparently, was not to return calls.

Is That The Conquistador? They Run Tight.
Well, you’ve got to give Microsoft one point: they didn’t produce a conventional television ad.
Software giant Microsoft has kicked off its $300 million ad campaign to promote its Windows Vista operating system with a spot featuring comedian Jerry Seinfeld and Microsoft founder Bill Gates having a chance meeting at a fictional store called Shoe Circus, Seinfeld helping Gates into a pair of size 10 “Conquistadors,” and Bill Gates “adjusting his shorts” as a signal Microsoft has big things in the works. The ad is available via Microsoft’s Web site using the company’s Silverlight technology; copies are also popping up on YouTube.

And the walls came tumblin’ down: the world’s second-largest music label, Sony BMG has announced it will test selling digital music in DRM-free MP3 format via a new Platinum MusicPass card. The cards will enable consumers to download full albums in MP3 format, and in some cases buyers will be able to access exclusive bonus content.
Platinum Equity Buys Covad for $304 Mln
Another communications company has gone private, as Platinum Equity Parters enters and agreement to acquire voice and data provider Covad for $304 million (PDF).
Covad is based in San Jose, California, and provides broadband and VoIP services, mainly to small and medium-sized businesses. Covad says there will be no immediate changes in service for customers, and the acquisition will give the company the ability to invest in growth strategies which will bring the company into profitability. Although Covad was able to weather the first dot-com blowout, the company cut about 8 percent of its staff in June as part of a restructuring which also took $1.5 million off the company’s bottom line for the quarter.
Second Life Avatar Sued
Have you ever heard of the SexGen Platinum? If you’re a regular on Second Life, you might well have done – you might even own it. Nowit’s at the center of a lawsuit, which most believe to be the first real life suit between avatars. So what is SexGen Platinum, anyway? It’s the creation of Kevin Alderman (knownon the site as Stroker Serpentine), who realized that people who had avatars on the popular site wanted their characters to not only have realistic genitalia, but also to have them able to have sex. SexGen Platinum, which he sells for $45 through his company, Eros LLC, is a piece of code that lets the avatars take on sexual positions. It’s placed in various objects, such as a bed, then the user clicks on the menu and can take part in a choice of sex acts. All was well until someone broke the code and began selling unauthorized copies of SexGen. According to a suitAlderman filed last month in Tampa, Fla., the culprit is someone who uses an avatar named Volkov Catteneo. While Alderman allows uses to transfer his products, he doesn’t allow copying. “We confronted him about it and his basic response was, ‘What are you going to do? Sue me?’” Alderman said. “I guess the mentality is that because you’re an avatar …that you are untouchable. The purpose of this suit is not only to protect our income and our product, but also to show, yes, you can be prosecuted and brought to justice.” Second Life, created by Linden Labs has become big business. A number of major companies have a presence there, and beyond your basic avatar, everything costs money. Virtual money, known as Lindens, can beexchanged for U.S. currency ay 270 Lindens to the dollar. Linden Labs has already been forced to stop gambling in Second Life for fear it might violate gambling laws. Alderman is just one ofmany entrepreneurs on Second Life. He has a shop there, and is investing money in a motion capture machine that will make the sex moves of avatars more realistic. His July 3 suit accuses VolkovCatteneo – or at least his currently unknown owner – of violating copyright and trademark protections by copying, distributing and selling copies of Sex Gen. Alderman is seekingunspecified damages.
