It’s a legal fight that’s been brewing for over a year, but now a heavy hammer has come down: U.S. District Judge William Alsup has ruled categorically against Mac clone maker Psystar, finding the company violated Apple’s copyrights by pre-installing Mac OS X on its own Intel-based computers. The judge also threw out Psystar’s motions that Apple was misusing copyright law to monopolize a market, and that Psystar had the right to do anything it liked with Mac OS X under the “first sale” doctrine.

Florida’s Psystar is mired in an increasingly preposterous legal battle with Apple over marketing Mac clones. Apple sued Psystar, Psystar sued Apple (that was eventually thrown out, and the company appears to have applied for bankruptcy protection while it gets ready to go to court. Psystar might be back on its heels, but that doesn’t mean the company is ceasing to innovate! Psystar is now offering Rebel EFI, a $50 application that enables “smooth interfacing between operating systems and generic Intel hardware.” In practical terms, that means it enables users to install Mac OS X on non-Apple hardware…an action Apple is likely to view as a violation of Mac OS X’s license agreement.

Mac Clone Maker Psystar Files for Bankruptcy

Renegade Macintosh clone maker Psystar stirred up a hornet’s nest by offering unauthorized Macintosh clones in the form of low-cost computer systems with altered version of Mac OS X on them, has filed for Chapter 11 bankruptcy protection in the southern district of California. In its petition, Psystar cites the current economic conditions as the primary reason for seeking bankruptcy protection, rather than the company’s pending legal action with Apple.

A judge has apparently closed part of the story in the legal dispute between Apple and Florida computer maker Psystar, dispmissing Psystar’s counter-suit against Apple. The dispute originated when Psystar, a heretofore essentially unknown small computer maker, began offering the OpenMac earlier this year, bootstrapping Mac OS X onto non-Apple hardware and offering at rates substantially lower than Apple’s typical retail prices. Apple eventually got around to suing Psystar for copyright infringement, trademark and trade infringement, and unfair competition; Psystar countersued Apple, claiming the company was engaging in anticompetitice behavior by preventing third parties from making Mac clones.

According to filing unearthed by The Mac Observer, Apple and would-be Mac OS clone maker Psystar have been forced into mediation talks by the judge handling the parties suits against each other. Apple has sued Psystar alleging copyright infringement for putting Mac OS X on non-Apple hardware, along with claims of trademark infringement and unfair competition. For its part Psystar sued Apple, claiming the Mac maker engages in unfair competition and violates antitrust law by not allowing others to ship Mac OS X on third-party hardware.

Remember when upstart computer maker Psystar began offering inexpensive Macintosh clones based on everyday PC hardware, and Apple finally got around to suing them, alleging copyright infringement, trademark infringement, and unfair compeition? Well, now Psystar has counter-sued Apple, alleging Apple is engaging in restraint of trade, unfair competition, and violating antitrust aw. The suit is being handled by antitrust specialists Carr & Ferrell, and seeks to have the end-user license agreement (EULAs) for Apple’s Mac OS X operating system declared invalid.

Psystar Claims $399 Mac Clone

Florida company Psystar claims to be selling OpenMac, a Macintosh clone built using off-the-shelf PC parts and shipping with Apple’s Mac OS X 10.5 “Leopard” operating system. Prices start at just $399 for a PC with a 2.2 GHz Intel Core 2 Duo processor, a 250 GB hard drive, 2 GB of RAM, a DVD±R optical drive, and 4 USB ports. For additional money, Psystar says users can get FireWire connectivity and an Nvidia GeFore 8600 GT graphics card…and Leopard pre-installed.
