Samsung Exec Pleads Guilty in DRAM Case

The ongoing investigation into price fixing in the market for dynamic random access memory (DRAM) has chalked up another victory, as Young Hwan Park, president of Samsung’s U.S. subsidiary pleads guilty to violations of the Sherman antitrust act for having conspired to fix prices and eliminate competition in the DRAM market.

To date, 18 individuals and four companies have been charges in the U.S. Department of Justice’s probe into the DRAM market. So far, more than $730 million in criminal fines have been assessed in the case, making it the second-largest price-fixing case in U.S. history.

RIAA Issues 761 New Lawsuits This week

Twenty-five of the lawsuits brought by the Recording Industry Association of America (RIAA), on behalf of the major record companies, were against individuals using a university Internet connectionto illegal distribute music files on unauthorized peer-to-peer services such as eDonkey, Limewire and Kazaa.

The university networks used by the 25 individuals who were sued today include: American University, Amherst College, Assumption College, Boston College, Boston University, Bridgewater State College, Emerson College, Iowa State University, James Madison University, Mount Holyoke College, Northeastern University, and the University of Massachusetts.

New Music Downloads Service By PassAlong

PassAlong Networks(TM), a new company launching today, announced the debut of its digital music download service and sharing network, marked by the company’s launch of the first digital music storeon eBay to feature music catalogs from the major labels. Simultaneously, PassAlong Networks launched its own digital music store at http://www.passalong.com/. On both sites, consumers can choose from more than 200,000 songs from major labels. By the end of the month, both sites will include the complete digitalcatalogs from Warner Music Group, Sony BMG, Universal Music Group and EMI, for a total of over 500,000 titles.

Exclusive artist promotions will also be featured at both sites, beginning with a current promotion featuring RCA Recording artist Avril Lavigne. Fans can bid on one of two eBay auctions sponsored by PassAlong with the winning bidders receiving a 15-minute phone call from Lavigne and a digital download of her latest album, Under My Skin. The auctions will end on September 30. At Lavigne’s request, proceeds from both auctions will go to War Child, http://www.warchild.com/, a network of independent organizations working across the world to help children affected by war.

RIAA Launches New Wave Of Suits

Music lawyers filed the newest cases against 532 “John Doe” defendants – identified only by their IP addresses – and expected to work through the courts to learn their names and where they live.

The recording association said each person was illegally distributing an average of more than 800 songs online. Each defendant faces potential civil penalties or settlements that could cost them thousands of dollars.

The resumed legal campaign was intended to discourage music fans emboldened by last month’s federal appeals court decision, which dramatically increased the cost and effort to track computer users swapping songs online and sue them.

Music group settles with 52 file sharers

The Recording Industry Association of America, which plans to file hundreds more lawsuits in October, did not specify how much it collected from the settlements it announced on Monday.

Defense lawyers familiar with some cases said payments ranged from $2,500 to $7,500 each, with at least one settlement for as much as $10,000.

No admission of wrongdoing

The settlements, which do not include any admission of wrongdoing, require Internet users to destroy copies of illegally downloaded songs and agree to “not make any public statements that are inconsistent” with the agreement.

Music piracy suit targets 261 downloaders

The lawsuits, filed in federal courts around the country, targeted people who make songs on their computers available to others online — making a distinction between people who download and those who distribute. The suits did not name Internet file-sharing services like Kazaa, Gnutella and Grokster, which enable the downloading of millions of songs.

By late Monday, no suits had been filed in Sacramento, but about 20 were filed in federal courts in San Francisco, Oakland and San Jose.

Music industry slams ISPs with subpoenas

The Recording Industry Association of America is seeking subpoenas, at a rate of 75 a day, to force Internet providers to release the names of customers suspected of downloading bootlegged songs online.

It’s the music industry’s first step toward curbing online piracy at the source — individual computer users. When it gets the names from Internet companies, the industry plans to file civil lawsuits to stop the practice — and deter others with the threat of penalties of $150,000 per stolen song.

Internet service providers call the torrent of subpoenas an unprecedented action.

Music industry group sues college students

…where it claims the networks are being used to illegally trade copies of digital music files.

The Recording Industry Association of America said its member companies filed suit against two students at Rensselaer Polytechnic Institute and against one student each at Princeton University and Michigan Technological University.

The RIAA has actively used the courts to pursue digital music pirates after a 9 percent dip in CD sales in 2002 that it blames for the most part on online file sharing.
