Now Craigslist Sues South Carolina Attorney General

The Craigslist saga continues, and to prove the fact that we live in a litigious world, the online classifieds site is now suing the South Carolina Attorney General, Henry McMaster.

It’s a response to the AG’s statement that he was considering a criminal investigation into the site, and Craigslist says the suit is actually an attempt to get "declaratory relief" – an attempt to get a judge to decide whether one set of rights unfairly infringes upon another; in this case a criminal investigation on the one hand, and freedom of speech on the other.

Last week Craigslist bowed to pressure from the attorneys general of many states and cut its Erotic Services classifieds section, replacing it with more closely monitored Adult Services ads.

But that, it seems, wasn’t enough. South Carolina Attorney General Henry McMaster has announced that he will stake further steps against the classifieds site, saying:

"We have no alternative but to move forward with criminal investigation and potential prosecution."

That’s brought an impassioned defense of Craigslist from its boss, Jim Buckmaster. In a blog post, he wrote:

For the most part, Craigslist doesn’t charge for ads posted on its classifieds site. There is one exception, however, and that’s its listing for Erotic Services. There, listers not only have to pay, but also give credit card and phone details.

But in the wake of bad publicity and the case of Boston’s so-called Craigslist killer, the site is facing a wave of bad publicity over that particular section, which one official has dubbed the “single largest source of prostitution” in the US. In South Carolina, the attorney general gave Craigslist a 10-day deadline to remove all sex-related posts from sites covering the state.

Dell Settles Finance Claims for $3.35 Mln

Computer maker Dell has agreed to pay some $3.35 million to settle 34 states’ allegations that the company’s warranty, financing, and rebate offers were deceptive and misled consumers. The agreement has Dell paying $1.5 million into a restitution account; impacted consumers will be able to submit claims for compensation. The other $1.85 million will go towards the states’ legal costs.

“More than the money, this agreement provides profoundly important business practice reforms,” said Connecticut attorney general Richard Blumenthal, in a statement. “No more bait-and-switch financing—offers touting zero-interest that become surprise high-interest charges or astounding late penalties. Our strong coalition of states will closely monitor and enforce this agreement, which has been reached with Dell’s cooperation.”

Philips Acquires iPod Accessory Developer

Philips Electronics announced today plans to acquire Digital Lifestyle Outfitters (DLO), a popular maker of accessories for devices like the Apple iPod. Financial details of the deal were not disclosed and the deal is expected to close in the second quarter of this year.

DLO, with operations in Charleston, South Carolina and Raleigh/Durham, North Carolina, will be folded into the Peripherals & Accessories business unit of Philips’ Consumer Electronics division. This unit, which Philips says has seen increased sales over the last several years, may well benefit from DLO’s niche of developing accessories, including docking stations, FM transmitters, cables and cases for mobile audio-visual devices such as MP3 and video players. DLO alone last year made around $100 million in sales, mainly in the United States.

Families Sue MySpace Over Online Predators

Families from New York, Texas, Pennsylvania, and South Carolina have filed suit against News Corp’s enormously popular social networking Web site MySpace, alleging gross negligence, fraud, and negligent misrepresentation after their underage daughters were sexually abused by adults they met via the Web site. Each case alleged that an adult member of MySpace contacted the girls through the site, obtained personal information, and later assaulted the minor. According to the filings, one of the assaults occurred in Ohio.

AOL Tells Customers To Find New Carrier

“America Online, which earlier this year stopped signing up new broadband customers, is telling existing broadband subscribers in nine Southern states that they must find a new broadband carrier by Jan. 17.

Bentley said she expects AOL will phase out existing broadband customers in the rest of the country in a similar manner over the next year.”

The affected states are Florida, Kentucky, Georgia, Louisiana, Alabama, Mississippi, Tennessee, North Carolina and South Carolina.
