Privacy Suit Slams Facebook

A new suit filed against Facebook in Orange County alleges that the social networking site violated California law by reposting copyrighted images without approval, and also letting personal information of minors to be posted and shared without parental consent. The suit has been brought by three adults and two minors.

In part, the suit alleges:

"Facebook’s interface and web site architecture causes users to believe and understand that personal information and photos uploaded to Facebook are private."

"Users may be unaware that data they submit, or that data others submit about them, may be extracted and then shared, stored, licensed or downloaded by other persons or third parties they have not expressly authorized."

Yahoo, Microsoft, and Real Networks Sued Over Copyright

MCS Music America, a copyright administration outfit that’s a subsidiary of the British firm Conexion Media Group PLC has filed suit in a Tennessee court against Microsoft, Real Networks, and Yahoo, claiming the companies’ streaming services provide access to tracks that the companies do not have permission to distribute. The suit seeks $150,000 for each act of infringement—meaning every time the songs are downloaded or streamed—and to have the tracks immediately removed from the online music services. The suit covers tens of thousands of tracks from a dozen or more music labels and artists like Aretha Franklin, Emmylou Harris, and even Grand Funk Railroad.

Last August, Apple revised the design and replaced its MagSafe adapters for consumers, and as early as October 2007 it was getting ready to bring in new 85-watt MagSafe adapters for MacBook Pros following a raft of complaints.

According to AppleDefects.com, which had pictures, the adapters could get so hot that cables melted.

Now it’s all culminated in a class action law suit, brought in California by Naotaka Kitagawa, Timothy Broad, and Jesse Reisman. According to a report in The Register, the suit covers both the 85-watt and 60-watt adapters, alleging that the cable "dangerously frays, sparks, and prematurely fails to work."

Klausner Sues Google, Verizon On Voicemail

Inventor Judah Klausner—generally considered the “father of the PDA” for his work creating electronic organizers in the 1970s—has filed a new patent infringement lawsuit targeting Google, Verizon, LG, Citrix, Cox Communications, Embarq Corporation, and others for infringing on patents Klausner believes covers visual voicemail. And Klausner has some courtroom history to back him up: he went after Sprint and Apple with similar claims, and won agreements from them both earlier this year; Comcast has also reportedly struck a deal. Klausner also won settlements from Vonage and AOL, and, last we heard, was still pursuing similar claims against Skype and Cablevision.

Alabama resident Jessica Alena Smith has become the first to file suit against Apple for sub-standard 3G performance in its new iPhone 3G. And she’s requesting her suit be granted class-action status, owing to the large number of iPhone users who are experiencing dropped calls and unreliable 3G data service from the devices.

Vizio Sued Over MPEG Video Patents

A number of the world’s leading manufacturers of high-definition televisions have filed a patent suit against low-cost HDTV maker Vizio, claiming the company is violating some 15 patents key to supporting MPEG-2 video in its products. According to the complaint, both the individual companies—which include heavy hitters like Sony, Samsung, Mitsubishi, and Phiips—has pursued Vizio about licensing the patents, but the company has refused to deal with them individually or with the MPEG Licensing Authority trade group. The suit was filed in federal court in Manhattan on June 2; other parties to the suit include Columbia University of New York, Victor Co. of Japan, and Thompson; the suit seeks an order to prevent Vizio from using the patents, as well as financial compensation.

A Suit Fit For An iPod – Really!Perhaps it was inevitable, given the ubiquity of the iPod: Someone has designed a business suit for it.   The two-piece employs so-called“smart fabric” technology to allow controls to be built into the lapel, enabling the wearer to switch tracks on their iPods without having to go to the excruciating effort of removing thedevice from their pockets.   According to a spokesperson for the makers, the Eleksen Group, the fabric will transform the lapel “into a five-buttonelectronic control panel” and make “clothing into must-have fashion for the billion-dollar portable MP3 and mobile phone market.”   The suit will be available initially inBritain, sold by Marks & Spencer at nine of its department stores. Made from wool and lycra, and available in a classic black pinstripe, two buttoncut, it will be priced at around $300, although the jackets and pants will be available separately for about $180 and $120, respectively.   As fashion accessories go, this is a pretty big step,and the tailoring has been specifically designed to accommodate the iPod. A connector is sewn into the pocket, and there are loops within the jacket to keep the ear pod wires well out of sight.However, when the user wants to switch albums or artists, he will have to remove the device from his pocket.   Perhaps unsurprisingly, the suit is dry clean only.   Suits you, sir?

Microsoft Sued Over VPN Technology

California software company VirnetX Inc. has files suit against Microsoft Corporation, alleging the software giant’s VPN technologies infringe on two VirnetX patents, one of which describes a method for establishing a secure communications link, and the other describes transparently creating a virtual private network. VirnetX’s suit seeks both injunctive relief and damages; the suit was filed in the patent holder-friendly United States District Court for the Eastern District of Texas.

VirtnetX’s brief statement does not specify which Microsoft products infringe on its patents; Microsoft’s Internet Security and Acceleration Server offers VPN capabilities.

New York AG Sues Gratis Over Personal Info

New York Attorney General Eliot Spitzer has filed suit against Washington D.C.s Gratis Internet for what it describes as “the largest deliberate breach of privacy in Internet history.”

Gratis operates numerous Web sites including FreeiPods.com, FreeCDs.com, FreeDVDs.com and FreeVideoGames.com, which promised users free products, generally by participating in free trials of other products. According to the suit, Gratis promised confidentiality to site users, but instead Gratis owners Peter Martin and Robert Jewell turned around and sold personal information belonging to between one and seven million customers to three independent email marketers during 2004 and 2005.

Spammer Sues Anti-Spammer For $4 Million

“Can you imagine trying to get someone to stop spamming you, only to be sued for a whopping US$4 million? That’s exactly what has happened to Mark Mumma, after he took his displeasure with Cruise.com to the web, and started threatening to collect the fines he believed he was due.

Omega World Travel sued Mumma with what is commonly called a SLAPP suit, short for “Strategic Lawsuit Against Public Participation.” The general idea is to silence critics by dropping a massive suit on them, and watching them run off with tail firmly planted between legs.”
