eBay Wins Counterfeit Court Case

During June, eBay lost a pair of European lawsuits over the sale of counterfeits on the auction site. Yesterday it reversed that slide when a New York judge ruled that it couldn’t be responsible for the sale of counterfeit goods on its site, in a suit brought by jewelry company Tiffany.

Retailers have felt that eBay’s current reporting and protection system for counterfeits doesn’t go far enough, but the decision by Judge Richard Sullivan indicated that their procedures are adequate, effectively putting the onus on manufacturers and designers to protect their brands.

In a statement, eBay said:

eBay is a little poorer today. The giant Internet auction site has been fined 20,000 Euros (about $31,000) for allowing counterfeit goods to be sold through its auctions after a suit was brought in France by luxury goods maker Hermes. That could set a precedent for future suits, which could include those brought by Tiffany and Louis Vuitton.

eBay has honoured requests to remove counterfeit items from auctions. However, in many ways counterfeits sold there are small potatoes, as one estimate says that 10% of all global sales of branded goods are counterfeit.

Just months after launching a revamped version of their online video portal, AOL has decided to ditch its year-long experiment with offering movies and television shows for sale online, instead partnering with Amazon.com Unbox to offering digital video downloads to its users. Neither AOL nor Amazon disclosed the terms of the deal, but Amazon will apparently be sharing advertising revenue with AOL.

AOL launched its pay-to-download service in mid-2006 with content from 20th Century Fox, Sony, and Universal. AOL later added movies and televisions shows from Paramount, including the Star Trek franchise and classic movies like Breakfast at Tiffany’s.

AOL Adds Paramount to Video Downloads

On the heels of Google’s acquisition of YouTube and Apple’s still-runaway success selling video via iTunes, AOL continues to ratchet up its claim to be a one-stop source for all online video needs: today, AOL announced a new arrangement which makes movies and television shows from Paramount Pictures for sale via download. Prices for movies will range from $9.99 to $19.99 apiece.

The move puts Paramount content on AOL’s new video portal alongside video from Warner Bros. Home Entertainment, 20th Century Fox, Sony Pictures Entertainment, and Universal Pictures, which were all on board when AOL launched its video service in August.
