eBay to Ban All Ivory Sales

A new report from a href=”http://www.ifaw.org/”>International Fund for Animal Welfare reports finding more than 4,000 elephant ivory listings on the popular auction site eBay—and more than 7,000 wildlife product listins on over 180 Web sites in 11 countries. As a result, eBay has agreed to ban the sale of all ivory products beginning January 1, 2009.

“We feel this is the best way to protect the endangered and protected species from which a significant portion of ivory products are derived,” the company wrote in its blog.

U.S. Complains About E.U. Tech Tariffs

AP has reported that the US has filed a complaint with the World Trade Organization about the tariffs imposed by the EU on three categories of high-tech goods.

According to the Information Technology Information Council, a body whose members include HP and Apple, the EU duty runs as high as 14%, which makes US products, such as printers and monitors, less competitive in Europe.

The US claims that the tariffs violate a 1996 WTO agreement that removed tariffs on IT equipment.

U.S. Trade Representative Susan Schwab said:

“The EU is effectively taxing innovation.”

BSA, Intel Back Apple Trade Secret Suit

“Apple contends that its “trade secrets” were unlawfully disclosed and issued subpoenas insisting that the sites reveal their anonymous sources. The defense contends that Internet reporters and bloggers are protected by shield laws, which afford journalists protection under the California constitution and under the First Amendment guaranteeing free speech.

In his ruling, Judge Kleinberg disagreed with the defense’s arguments and sided with Apple, singling out O’Grady’s PowerPage. Kleinberg wrote, “An interested public is not the same as public interest.” But what is in the public’s interest is a grey area and not everyone sees eye-to-eye. The judge left open the question of what constitutes a journalist, stating that it was a moot point when trade secrets laws are violated. “

Japan Watchdog Slaps Warning On Microsoft

Microsoft issued a statement within hours of the warning, saying it would contest the decision.

Fair Trade Commission official Toshihiro Hara said the warning was the first in the world against the clause, which he said in effect prevents Japanese computer makers from demanding damages or royalty fees even when rivals violate patents for important technology.

Such concerns have increased over the last several years as Japanese manufacturers add consumer-electronics features to Windows-installed computers, he told reporters at the trade ministry.

RIAA Drops Amnesty Program For File Sharers

The trade group quietly announced that it had ended the Clean Slate offer earlier this month on its Web site, but the news didn’t become widely known until Monday, when the RIAA submitted a document in a California lawsuit that contended that the program was misleading.

Clean Slate had promised not to prosecute individuals who vowed to erase unauthorized content from their computers, destroy hard copies of illegally obtained copyrighted materials and abstain from future file swapping–all in a notarized apology sent to the trade group.
