EU: Breakthrough on Online Music Rights

euThe EU’s top antitrust official on Wednesday described a deal among Apple Inc.’s iTunes, music companies, distributors and online licensing groups as a “great breakthrough” that would roll out more Internet music sales across Europe.

The companies and rights holders agreed at talks held Tuesday to work on EU-wide licenses that would allow online music tracks to be sold more widely in the region. Internet music downloads in Europe lag behind those in the United States, pulling in just a fraction of revenues the record industry is losing from falling CD sales.

Deviating from the new breed of high-end universal remotes that require PCs, Internet connections, and possibly Ph.D.s to set up, Universal Remote Control released a new model on Wednesday that returns to simplicity. The Digital R50 LCD remote can be programmed without any outside gear, and has its entire library of IR codes built right in.

Instead of PC programming, the R50 uses a built-in wizard to walk users through setup right on its own screen. It borrows the Universal Remote’s ProPerfectDatabase from the company’s professional line of products.

Universal Studios used to be the staunchest backer of Toshiba’s HD DVD high-definition disc technology, being the only movie studio that didn’t either sit on the fence and support both HD DVD and Blu-ray, or just skip HD DVD altogether and go for Blu-ray from day one. However, when Toshiba folded the HD DVD format back in February, Universal said it regretted that HD DVD hadn’t worked out, but wasted no time in saying it would begin issuing titles in the victorious Blu-ray format. The company is expected to unveil its first slate of Blu-ray titles today, with its first entry into Blu-ray media being Neil Marshall’s box office under-performer Doomsday this July.

DOJ Launches Inquiry into Total Music

The U.S. Department of Justice has reportedly launched a preliminary investigation into “Total Music,” an idea originally floated in October of last year by Universal Music president Doug Morris. The basic idea: build the cost of subscribing to unlimited digital music for a fixed period of time into the cost of hardware players. Under Total Music, hardware makers would essentially by subsidizing the cost of subscribing to the music service; Universal has been talking about a subscription fee in the range of $5 a month, which would add about $90 to the cost of a music player expected to be in use for 18 months. Universal has been talking with other music labels in an effort to get them to back the idea.

Universal To Go DRM FreeFollowing the lead of EMI, Universal Music Group has decided to sell agood part of its catalogue online without the usual copyright protection. The experiment will run for at least a few months.   Universal would offer the digital right management (DRM) freemusic through a number of sires, including Real Networks and the young service from Amazon.com, as well as artists’ ownweb sites.   But one place you won’t find it is Apple’s iTunes, although that’s the leading download service. EMI has a deal to sellDRM-free music with a higher audio quality via iTunes Plus, but at $1.29 a track instead of the usual 99 cents for those with copy protection.   The proprietary DRM normally used by iTunes onlyworks with iPods and the iTunes application, which means DRM-protected music sold by competing services isn’t playable on the iPod. Similarly, iPods don’t support non-Apple DRM technology. DRM-freetracks like those sold by EMI (and now Universal) will operate on almost all music players and devices, including iPods.   If Universal decides to make the experiment permanent, and this toe inthe waters is seen as a chance to gauge both consumer demand and how the move affects online music piracy, then it will increase the pressure on labels – and on Apple. Only last month Universaltold Apple it would not sign a new long-term contract to sell music through iTunes.

Veoh Files Pre-Emptive Suit

Veoh Files Pre-Emptive SuitHearing that the Universal Music Group (UMG) was considering filing suit against it for copyright infringement, video-sharing site Veoh has decided that attack is the best form of defense. It’s filed suit against UMG, asking a judge to prevent UMG from filing a copyright infringement action.  It’s a bold and unusual step, but Veoh claims it’s entitled to protection under the safge harbour provision of U.S. copyright law, since it doesn’t encourage its users toinfringe copyright and goes beyond legal requirements to investigate and remove offending material. Veoh has asked a judge to declare that it has no liability to Universal even if users upload videoswith music by Universal artists without permission.   The company has taken the action after being informed by Universal last month that the giant was considering suing it for “massivecopyright infringement.” Veoh said Universal offered it no details.   “It is unfortunate that U.M.G. prefers to take actions that are designed to stifle innovation, shut down newmarkets and maintain the status quo instead of working to change and evolve models for today and the future,” Veoh’s chief executive, Steve Mitgang, said in a statement.  Previously, Universal head threatened to sue Google-owned YouTube, but the two sides struck a licensing deal instead.  

Universal Music Sues MySpace

Universal Music Group has filed a copyright infrigement lawsuit against popular social networking Web site MySpace, alleging the site illegally enables users to upload and share music videos from Universal artists.

Universal Music Group is the world’s largest record label, with a roster of artists including U2, Jay-Z, Gwen Stefani, The Killers, and many more. The move comes justas MySpace announced it is testing new technology to enable copyright holders to flag infringing video on MySpace and get it taken down promptly.

Amazon Subsidiary Brings Us TV Greats

Amazon.com subsidiary CustomFlix Labs today said they’d reached agreements with NBC Universal, A&E Home Video and PBS to begin making available popular broadcast content via a new “DVD on Demand” service on the Amazon.com Web site. Financial terms of the deals were not disclosed.

Under this new DVD on Demand service, said CustomFlix, content from television programming networks’ vast library of normally archived material is being encoded and distributed on to DVDs as consumers select and purchase them online. For NBC, this includes a wide variety of titles such as the “Westminster Kennel Club Dog Show” and a compilation of popular “Where in the World is Matt Lauer?” segments from the “Today” show. More NBC titles are being added on an ongoing basis, with many DVDs being pre-sold during the initial airing of the broadcast.

Vivendi Universal Games today announced its upcoming line up of second and third quarter 2006 mobile game titles. Six games will be made available for purchase and download to compatible phones.

Macworld Challenges Intel iMac Speed Claims

Apple Computer made a lot of press earlier this month by introducing Intel-powered iMacs and the new MacBook Pro notebook earlier this month at Macworld Expo, touting performance of the new iMac with the new Intel Core Duo CPU as being up to twice as fast as it PowerPC G5-based predecessor. However, in tests, Macworld Labs finds the speed gains in the Intel-based systems far less substantial, and, for software which hasn’t been recompiled for Intel systems, performance is more like one-half that of the previous model.
