Writer dumps publisher, launches self-publishing venture, over e-book royalties

The argument between the author of a best-selling memoir and his publisher over the amount of royalties he was owed from sales of the digital editions of his work, has led to the author not only leaving the publisher, but going on to set up a new publishing house for himself and calling on other writers to join him.

Joe Simpson, a mountaineer whose book Touching The Void chronicles a life-and-death struggle to survive in the Peruvian Andes, ended what he described as a “huge dispute” with Jonathan Cape, by splitting with the company and branding them as bullies who unfairly try to keep money from authors.

“They thought they could bully me into accepting 25-percent royalties even though I owned 100 percent of [the rights],” Simpson explained in a YouTube video he released to announce the new self-published edition of the book. “[It] seems to be a fairly common tactic of the big publishing houses,” he went on. “They like intimidating and bullying their authors, basically threatening to not publish them any more if they won’t accept these ridiculous royalty rates.”

25-percent royalties on digital editions is a common figure for mainstream publishers, despite outcry from authors who believe that the reduced cost of manufacturing required for e-books should mean a higher rate of royalty (50-percent is one figure that has been bandied about). When considering the reduced rate of manufacturing required for digital books, Simpson apparently took that logic further and started questioning whether or not he could handle being an e-book publisher himself.

“I realized when I had this battle with them that I didn’t need them,” he explained. “We don’t really need [publishers] as much as they would like us to think. OK, they have all the influence over book marketing and publicity, they have all the literary editors of the newspapers and magazines in their pockets, and they can ratchet that up, but they don’t need to take 75-percent of your royalties to do that.”

The result of this train of thought is the creation of DirectAuthors.com, a digital publishing company created and owned by Simpson that plans to offer 40-50 percent to authors on e-book sales. “There is a certain amount of debate in the industry about royalty rates,” admits the company’s managing director, Marek Kriwald. “Some people are quite happy with whatever’s offered, and others analyze the situation and decide it should be different… You have to question 75-percent [going to the publishers] – there’s very little they need to do for that money.”

A spokesman for Random House, the parent company of Jonathan Cape, released a statement in response to Simpson’s comments, saying that the company was “disappointed to have not been able to reach an agreement with Joe about his e-book publishing, however we continue to publish his books in physical format.”

Today, the digital comics revolution got just a little bit more interesting with the announcement that ComiXology - the digital comics engine behind apps and storefronts for major publishers including both DC and Marvel Comics - has created a free submissions portal called ComiXology Submit that will enable unsigned creators to self-publish their work digitally and make it available alongside titles like Batman, Avengers and The Walking Dead.
“When we started ComiXology it was with a handful of comics from deals done directly with creators and very small publishers,” said co-founder and CEO of the company, David Steinberger. “We are happy today, with the announcement of ComiXology Submit, that we now have a turnkey system to service this incredibly vital part of the marketplace. ComiXology Submit, helps keep the promise to our customers of having the best and most diverse comic books and graphic novels available worldwide.”
The Submit engine will allow new and established creators to upload their work for review by a team within ComiXology - Something that is being done, Steinberger has said, not to ensure a specific format or subject matter, but instead that the submissions are of a high enough quality to be featured alongside professional work - with the work then being made available, post-approval, at a price of the creator's choosing, as long as it is above 99 cents. ComiXology will take 50 percent of the gross profit, once costs have been factored in (For example, anything bought on ComiXology via an Apple app automatically loses 30 percent of the price to Apple, meaning that the creator and ComiXology each get a 35 percent share).
Company co-founder John D. Roberts said in the press release announcing Submit that "Having the most diverse material possible serves comiXology’s mission." He went on, "Publishers have long known that comiXology is the most valuable platform for digital comics in the world and having a way to let self-publishers participate in that is good for our customers, for comiXology and for comics... It’s great that we can now open our platform to self-publishers and deliver a whole new wave of creative works to our customers."
Currently, ComiXology Submit is in a closed beta mode, only accessible via private invitation, although the company hopes to be able to launch it publicly early in the new year. An invited team of creators have already submitted material through the portal, and ComiXology is predicting that that material will be available in eight weeks or so. In the meantime, creators interested in getting themselves involved with the service can visit the ComiXology Submit website and sign up for emailed updates... and then start thinking about how to spend those potential future digital dollars come the public launch in 2013.

If you purchased an e-Book from Hachette, Harper Collins or Simon & Schuster between April 2010 and May of this year, you can pretty much count on seeing some money back from your purchase, as the three publishers have finally reached an agreement on a settlement amount to be paid to customers after settling with authorities over charges of price-fixing electronic releases earlier this year.
While the US Department of Justice is still pursuing legal action against Apple, Penguin and Macmillan over accusations of the publishers coming to an illegal agreement with Apple over the price of releases offered on iBooks - Attorneys representing the two publishers and Apple are due in court in June next year to contest the charges - Hachette, Harper Collins and Simon & Schuster quickly moved to settle after charges were filed against all parties last April. As a result of that settlement, it was announced today that the three publishers have agreed to contribute a collective $69,000,000 to a fund for customers affected by the alleged price-fixing.
The announcement was made by Tennessee Attorney General Bob Cooper today. In a statement, his office said that "Attorney General Cooper and 54 attorneys general in other states, districts and U.S. territories have reached an antitrust settlement with three of the largest book publishers in the United States," with the settlement the end result of a two-year investigation by the states and the US Department of Justice's Antitrust Division. "That investigation developed evidence that the five largest American publishers... conspired to end e-Book retailers' freedom to compete on price by taking control of pricing from e-Book retailers and substantially increasing the prices that consumers paid for e-Books," the statement continued, suggesting that such actions "prevented retail price competition resulting in consumers paying millions of dollars more for their e-books."
"This collective action should send a strong message that competitors cannot get away with price-fixing," Attorney General Cooper is quoted as saying in the announcement, adding "We will do everything within our power to stop competitors from colluding to artificially raise the costs the prices by millions of dollars more for some of the most popular e-Book titles."
In addition to the $69 million fund, the three publishers have agreed to cover the legal expenses of the states bringing the charges against them, estimated to be somewhere in the region of $7.5 million, and also to terminate existing agreements with specific retailers including Amazon and Barnes & Noble, a move that will allow retailers the ability to reduce e-Book pricing at their own discretion. Additionally, the agreement prohibits the sharing of "competitively sensitive information" regarding e-Book pricing with competitors for a five year period, as well as making forbidden any kind of Most Favored Nation clause that "could undermine the effectiveness of the settlement agreement."
