Konami Sues Over Rock Band Instruments

Video game developer Konami has filed a patent infringement suit against Rock Band developer Harmonix—along with publishers Viacom and MTV—alleging the video game violates three Konami patents (6,390,923 6,425,822, and 6,645,067) covering “simulated musical instruments.” The suit has been filed in the patent-friendly U.S. District Court for the Eastern division of Texas. Konami’s patents involve game controllers and apparatus that bear more than a passing resemblance to those used in Rock Band, although Harmonix also seems to claim to have patents on the game’s controller technology.

The lawsuit follows a similar claim from real music instrument maker Gibson, saying Guitar Hero (and Rock Band) violate a patent it holds on simulated concert experiences that enable users to participate or play along with a musical performance. But while Gibson’s patent describes a virtual reality 3D headset gizmo, Konami’s patents actually specify devices much like Rock Band controllers.

Guitar Hero publisher Activision actually cites three Konami patents in relation to its games, and is not currently the subject of any related litigation from Konami.

Legendary game studio Konami and Bloober Team, the developer behind horror games like Layers of Fear, The Medium, and Blair Witch, officially announced a "strategic cooperation agreement." This new game development contract has fans jumping back to the rumors that there is a new Silent Hill game on the horizon amid tons of rumors.

Earlier this year, it was reported that Bloober Team was hard at work on a horror game with a famous publisher and today's announcement finally revealed exactly which one. According to Video Games Chronicle, which broke the news, Konami stated it was "excited to work with Bloober Team and other highly regarded development partners to produce games from existing and new IPs."

Gearbox Software sues 3D Realms over the embattled Duke Nukem franchise

Gearbox Software, the studio behind the best-selling Borderlands franchise, is suing the parent company of 3D Realms, accusing the creator of the Duke Nukem franchise of breach of contract.

In a third-party complaint, filed Friday in the U.S. District Court for the Eastern District of Tennessee, Gearbox says Apogee Software (which owns 3D Realms) breached their 2009 contract by failing to deliver the Duke Nukem intellectual property “free and clear,” withholding details of a key agreement that impacts Gearbox's ability to publish (and republish) the franchise's titles. It's also alleging 3D Realms has refused to honor an indemnity guarantee that was part of that deal.
