The Pirate Bay Four escape the law: founders acquitted of copyright charges in Belgium

Their torrenting site may be one of the most notorious in the world, but the founders of Pirate Bay have been acquitted of all crimes related to criminal copyright infringement and abuse of electronic communications as per the decision of a Belgian court. While indicting the “Pirate Bay Four,” Gottfrid Svartholm, Fredrik Neij, Peter Sunde and Carl Lundström, may seem like a cakewalk, what with the seemingly mountainous evidence presented by the very nature of their site, their legal savvy allowed them to escape prison time — at least in Belgium.

According to the four men, all their ties to Pirate Bay were severed in 2006 when the joint decision was made to sell the company and the site to a Seychelles-based company called Reservella. Given that all the charges brought against the Pirate Bay Four detailed activity that took place between September of 2011 and November of 2013, the masterminds were able to successfully elude any sort of criminal liability on that basis. Because prosecutors have been unable to actually tie Svartholm, Neij, Sunde, and Lundström to any actions that took place during the two-year period in question, a Belgian judge was forced to throw the case out.

Despite the quartet’s recent stroke of good luck, they certainly haven’t been able to steer clear of all legal troubles in the last few years. In 2009, lawyers in Stockholm successfully brought copyright infringement charges against the founders, resulting in fines of $4.8 million, as well as a year-long jail sentence. The jail sentence was amended to a shorter stint in prison, but imposed a heftier sum, ultimately costing the four $6.9 million.

Still, the Pirate Bay Four seem relatively unperturbed by the legal ramifications their actions have brought upon themselves. “Things were not too bad in prison,” Neij told the Inquistr after being released from a Swedish prison on June 1. “It was well worth doing prison time for The Pirate Bay, when you consider how much the site means to people.”
