A gamer has sued the makers of the MMO Lineage II, claiming that the game is so dangerously addictive, he spent 20,000 hours over five years playing, and that he became “unable to function.”

Hawaii native Craig Smallwood is claiming that the game Lineage II is so addictive that for five years, he apparently lost all measure of self-control and became  “unable to function independently in usual daily activities such as getting up, getting dressed, bathing or communicating with family and friends.”

Smallwood is suing Lineage maker, NCsoft of South Korea, claiming that the developer should pay an unspecified amount of money due to the addictive nature of the game. The suit states that Smallwood played the game between 2004 and 2009 for 20,000 hours, but would not have played if he were aware of the addictive nature of the game.  To put that in context, that entire five year period was only 43,848 hours, meaning that for nearly half of every moment over the five years, Smallwood was playing Lineage II, which Smallwood blames on the game.

”In light of plaintiff’s allegations, the court finds that plaintiff has stated a claim for both negligence and gross negligence,” U.S. District Judge Alan Kay stated in a ruling that was obtained by Wired.

For those that have not spent nearly half of the last five years playing it, Lineage II is a MMORPG that was released in 2003. Since the initial release, the game has seen several updates and expansion packs, and even now more are planned. As recently as 2007, the game still counted over 610,000 potential victims as active players.

This isn’t the first such claim against a game publisher. Typically, the defendant companies move for the suit to be immediately dismissed, and typically the judge agrees. NCsoft has again asked that the judge dismiss the claim, but for whatever reason, Judge Kay has decided that the case has enough merit to proceed.

I have played FFXI since I did the beta test and I have a good 800+ *DAYS* in that game, so I ALMOST have his arse whooped in time spent playing a MMO. But I never let it completely take over my life. He *chose* to play non-stop or w/e. The game didn't make him do it.

This is even worse than the guy who used every Axe product for years and is suing because he didn't get laid. Can I sue Heinz ketchup because their slogan is, "Grown, not made", yet every single ingredient is artificial? It never ceases to amaze me how people will place blame and exploit anything they can muster a loophole for. Selfish morons.

The world has become a horrid place. I think i will sue Budweiser because I drank 15 beers last night and it gave me a horrible headache in the morning.
  6. anonymous at 11:46am 26th August 2010 I played WoW since launch (Nov 2004?), and I have over a year, over 365 days PLAYED on it... that was the last time I checked... thinking back that's a solid year of my life i wasted playing a video game... and I'm an adult.

  7. Erich at 9:58pm 24th August 2010 Two girls got "large" and unhealthy from eating McDonald's, filed a law suit and won. Won big too. I wouldn't be surprised at all to find this case go far or settled. As a MMO gamer myself I realize how addicting games can be, but to sue because you have no self control is ridiculous. I hope they make him pay NCsoft for letting him play their game more then the designed amount.

  9. ioman at 10:05am 24th August 2010 Interesting to see how this plays out. I remember with FFXII came out, another popular MMO. Every time you went to play they showed a message reminding people to spend time with their family, get outside and have a real life. This was a game company telling their players! People really must get addicted to games, just look at World of Warcraft.
